These Terms of Use (“Terms”) govern your use of genak.ai (the “Site”), operated by GENAK Estates LLC, a Connecticut limited liability company (“GENAK,” “we,” “us,” or “our”). By visiting or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

These Terms cover only the GENAK corporate website. Each GENAK product — including Diabetes Action Layer, Dr. Spark Academy, and KDP Author Engine — has its own separate Terms of Service, which you accept when you create an account or use that product. The product-specific terms govern your use of the product itself.

1. Who we are

GENAK Estates LLC is a Connecticut limited liability company that publishes and operates digital products focused on health, education, and consumer well-being.

2. What the Site is for

genak.ai is GENAK's corporate website. It provides general information about the company and its products, links to individual products and their websites, company contact information, career and partnership inquiries, and news, blog posts, or other educational content about our work.

The Site is informational only. It is not a product, service, or tool you use to manage your health, education, or any other personal task. To do those things, use the appropriate GENAK product under its own terms.

3. Eligibility

You may use this Site if you are at least 13 years old (or the minimum digital-consent age in your country, whichever is higher). If you are accessing the Site on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Specific GENAK products may have higher age requirements — for example, Diabetes Action Layer is for adults 18 and older.

4. Acceptable use

You agree not to:

  • Use the Site for any unlawful purpose or in violation of applicable law
  • Copy, scrape, or republish substantial portions of the Site without written permission
  • Attempt unauthorized access to any part of the Site, our infrastructure, or accounts of other users
  • Probe, scan, or test vulnerabilities, or bypass security or authentication measures
  • Interfere with or disrupt the Site (bulk requests, malware, denial-of-service)
  • Frame the Site, or use automated tools to harvest information without written permission
  • Impersonate any person or misrepresent affiliation with any person or organization
  • Harass, threaten, or defame any person via the Site
  • Use the Site or any GENAK content to train machine-learning models without written permission

5. Intellectual property

5.1 Our content

All content on the Site is owned by GENAK or its licensors and is protected by copyright, trademark, and other intellectual-property laws. “GENAK,” “Diabetes Action Layer,” “DAL,” “Dr. Spark Academy,” “KDP Author Engine,” and related logos are trademarks of GENAK (registered or unregistered).

5.2 Limited license to you

We grant you a personal, limited, revocable, non-exclusive, non-transferable license to access and view the Site for your own non-commercial use. This license does not include any right to copy, modify, sell, lease, lend, sublicense, reverse engineer, or scrape the Site.

5.3 Your submissions

If you send us feedback, suggestions, comments, or ideas through this Site, you grant GENAK a worldwide, royalty-free, perpetual, irrevocable license to use them for any purpose without compensation or attribution.

6. Links to and from the Site

The Site contains links to our products and to third-party websites. GENAK does not control third-party sites and is not responsible for their content, accuracy, or practices. Linking does not imply endorsement.

7. Our products and services

Our products are offered under their own separate terms, privacy policies, and pricing. The Site may describe these products, but your use of any product is governed by the agreements between you and GENAK for that product, not by these Terms. In the event of a conflict, the product-specific terms control.

7.1 Health-related products

Our health products — including Diabetes Action Layer — are educational and decision-support tools, not medical devices. They do not diagnose, treat, cure, or prevent any disease. See our Disclaimer.

8. Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, GENAK DISCLAIMS ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GENAK AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, USE, OR GOODWILL. OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).

10. Indemnification

You agree to defend, indemnify, and hold harmless GENAK from claims arising out of your use of the Site, violation of these Terms, violation of any third-party right, or any content you submit.

11. Governing law and venue

These Terms are governed by the laws of the State of Connecticut, United States, without regard to conflict-of-laws principles. Disputes will be resolved exclusively in the state or federal courts in Tolland County, Connecticut.

12. Termination and changes

We may modify, suspend, or discontinue any part of the Site at any time. We may also restrict access if we believe you've violated these Terms. We may update these Terms from time to time — the "Last updated" date at the top will change. Continued use after changes means you accept them.

13. Miscellaneous

  • Entire agreement. These Terms (with our Privacy Policy and Disclaimer) are the entire agreement between you and GENAK regarding the Site.
  • Severability. If any provision is held unenforceable, the rest remains in force.
  • No waiver. Failure to enforce any provision is not a waiver.
  • Assignment. You may not assign these Terms without our written consent. We may assign in connection with a merger or sale.
  • Force majeure. We are not liable for delays caused by events beyond our reasonable control.
